Terms of service

1. Acceptance of Terms

By accessing or using Tradestar (“the Service”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. We reserve the right to modify these terms at any time. Continued use after changes constitutes acceptance.

2. Description of Service

Tradestar is a trade journaling and analytics platform. The Service includes:

• Automated trade journaling via read-only broker sync
• CSV/Excel trade import with column mapping
• Performance analytics and reporting
• Statistical market reports (Market Edge)
• An AI trading coach and trade insights
• Prop firm challenge tracking
• A marketplace for one-off digital trading products, including products sold by third-party creators
• Market data and news aggregation

Tradestar is not a broker, exchange, or financial advisor. We do not hold, manage, or have access to your trading funds, and we do not place, execute, or manage trades on your behalf.

3. Account Registration

• You must be at least 18 years old to use the Service
• You must provide accurate and complete registration information
• You are responsible for maintaining the security of your account credentials
• You must not share your account with others
• You must notify us immediately of any unauthorised access

4. Subscription and Payment

• The Service is offered at $49 per month, or $419 per year for an annual subscription
• Pro starts with a 7-day free trial. Your payment details are taken when you start it, nothing is charged during those 7 days, and the subscription begins automatically at the end of the trial unless you cancel before then
• The free trial is limited to one per account. If you have held a subscription before, checkout starts your subscription immediately and no trial is applied
• Payment is processed by Stripe. By subscribing, you agree to Stripe's terms of service
• Subscriptions renew automatically unless cancelled
• You may cancel at any time. Access continues until the end of the current billing period
• Subscription payments are not refunded once a billing period has started. A Pro subscription gives immediate access to digital content that cannot be returned, including indicator access, reports, and downloadable files
• Nothing in this section affects your statutory rights
• One-off Marketplace purchases are sold as seen and are non-refundable once completed (see Section 14)
• We reserve the right to change pricing with 30 days' notice

5. Acceptable Use

You agree not to:

• Use the Service for any illegal purpose
• Attempt to gain unauthorised access to the Service or its infrastructure
• Reverse engineer, decompile, or disassemble any part of the Service
• Use the Service to transmit malware, spam, or malicious content
• Resell, sublicense, or redistribute the Service without written permission
• Abuse the API, sync, or import endpoints (excessive requests, denial of service)
• Use the Service in a manner that violates your broker's terms of service

6. Fair Use Policy

Tradestar offers unlimited access to all features as part of your subscription. However, to ensure a quality experience for all users, the Service is subject to a fair use policy:

• The Service is designed for individual traders journaling their personal trading activity
• Usage that significantly exceeds what a reasonable individual trader would require may be subject to review
• Examples of usage outside fair use include, but are not limited to: connecting an excessive number of trading accounts, automated bulk importing at volumes inconsistent with personal trading, using the API, sync, or import endpoints in a manner that degrades service performance, or operating the Service on behalf of multiple unrelated users under a single account
• We reserve the right to contact you if your usage appears unusual, and to apply reasonable limits to protect service quality
• If your use case requires capacity beyond what the standard plan provides, contact us to discuss enterprise options

This policy exists to prevent abuse, not to restrict genuine traders. If you are using Tradestar to journal your own trades, you are within fair use.

7. Broker Connections

• Tradestar connects to brokers using read-only credentials (investor passwords, OAuth tokens) solely for the purpose of importing trade history
• We never execute trades, move funds, or modify positions through broker connections
• You are responsible for providing correct credentials and maintaining your broker account
• Tradestar is not affiliated with any broker or prop firm

8. Intellectual Property

• The Service, including its design, code, features, and content, is owned by Tradestar
• Your trade data remains your property. We claim no ownership over your trading data
• You may export your data at any time via CSV export

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• Tradestar is provided “as is” without warranties of any kind
• We do not guarantee uninterrupted or error-free service
• We are not liable for any trading losses, missed opportunities, or financial damages arising from use of the Service
• Our total liability to you shall not exceed the amount you paid for the Service in the preceding 12 months
• We are not liable for actions of third-party services (brokers, TradingView, Stripe, Cloudflare)

10. Termination

• You may close your account at any time from Settings
• We may suspend or terminate your account for violation of these terms
• Upon termination, your data is retained for 90 days then permanently deleted
• Sections 8, 9, 11, and 14 survive termination

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

12. AI-Powered Features

• Tradestar uses AI models to power the Trading Coach, support chat, and trade insights features
• AI-generated content is for informational purposes only and does not constitute financial advice
• AI responses may not always be accurate or complete; always verify important information
• Conversations with the AI support assistant may be stored for quality improvement and support purposes
• We do not use your trading data to train AI models

13. Affiliate Program

Any account (free or Pro) can share a referral link from the Referrals page. A working summary follows; this section governs.

• Attribution: the first affiliate link you click sets a sticky referrer for subscription commission, tracked for 90 days. A separate last-click cookie, tracked for 60 days, decides who earns commission on a one-off Marketplace purchase; these can be different people
• Rates: 20% of a referred user's Pro subscription payments for their first 6 months as a paying customer, and 40% of any one-off Marketplace purchase. Free-tier signups earn nothing until they upgrade or buy
• Clearing: commissions are held for 30 days after the underlying payment before becoming eligible for payout, as a chargeback buffer. Charged-back or fraudulent payments are removed before they clear
• Payouts: paid out directly once your cleared balance passes $100; balances below that roll over. There is no fixed payout date and no third-party payout processor; we arrange payment with you directly
• Voided activity: self-referrals, cookie stuffing, coupon or deal-aggregator site placement, and incentivised signups earn no commission and may result in link deactivation
• Disclosure: you must declare the affiliate relationship wherever you promote a link, in line with ASA (UK) and FTC (US) rules. Do not represent Tradestar as a signal service or promise trading profits

14. Marketplace and Digital Products

Tradestar operates a Marketplace where you can buy one-off digital products, including trading indicators, bots, scripts, templates, guides, and other downloadable or access-based digital content. Some are published by Tradestar and some by third-party creators. The following terms apply to every Marketplace purchase and are in addition to Section 4.

• All sales are final. Marketplace products are digital goods delivered immediately on purchase, including access to and copies of source code and other files that cannot be un-delivered once disclosed. For this reason a completed Marketplace purchase is non-refundable and non-returnable, and no exchanges or cancellations are provided
• Sold as seen. Each product is sold solely on the basis of its listing description, screenshots, and any preview provided. It is your responsibility to review the listing and confirm the product meets your needs before you buy. We do not warrant that a product will suit your requirements, be compatible with your platform, broker, or setup, or produce any particular result
• Immediate supply. By completing a purchase you request that the digital content be supplied to you immediately, and you acknowledge that you therefore lose any right to cancel or withdraw from that purchase once supply has begun. Any statutory rights that cannot lawfully be excluded are unaffected
• Pro subscription payments are treated the same way and for the same reason (see Section 4): access is delivered immediately and is not refunded once a billing period has started
• Licence and use. Unless the listing states otherwise, a Marketplace product is licensed to you for your own personal use only. You may not resell, sublicense, redistribute, republish, or otherwise share the product or its source code, in whole or in part (see Sections 5 and 8)
• Chargebacks. Raising a chargeback or payment dispute on a completed Marketplace purchase in breach of these terms may result in suspension or termination of your account and forfeiture of access to the content you have purchased and licensed

In short: Marketplace items are sold as seen and are not refundable, because buying one gives you immediate access to its source code and files. Review the listing carefully before you buy.
